Purpose / Scope

This LIVEE Privacy Policy applies to the policy implemented by the company LIVEE regarding the collection and use of your data when you browse the LIVEE websites (which includes the LIVEE mobile apps) or when using LIVEE services.

It explains

the origin and nature of the data that the company LIVEE collects,
the reason for its collection,
how we use it and
the rights you have over this data in accordance with the amended French Data Protection Act no. 78-17 of 6 January 1978 (the “Computing and Freedom Act”), and the EU Regulation 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data (the “GDPR”) (hereinafter together the “Applicable Regulations”).

Types of Data Collected by LIVEE

When you visit the websites or use LIVEE services, LIVEE collects data about you in two ways:

Directly, when you fill out our forms and/or newsletter requests by providing your personal information (such as your name, email address, etc.) (hereinafter the “Personal Information”); and/or automatically without you filling out forms (hereinafter the “Browsing Data”).

Collection of Your Consent

To achieve the purposes listed in the LIVEE Privacy Policy, LIVEE may create a file containing Personal Information provided when creating a user account, filling out forms and/or using LIVEE websites and/or services.

You are hereby informed of the terms and conditions under which LIVEE processes your Personal Information.

You can express your prior and explicit consent to the collection and processing of your personal data by LIVEE, on the LIVEE websites and/or when using LIVEE services in accordance with the provisions of the French Data Protection Act (notably via check boxes).

Personal Information Collected by LIVEE

LIVEE may directly collect the following personal data from you when creating a user account, filling out forms and/or using the websites and/or services:

Your name, first name, title, email address, date of birth;

Name of your company, your country, your phone number;

Postal and/or delivery address;

Your identifiers (username and password);

Your opinions on LIVEE services.

When we collect personal data via our forms, we indicate which personal data is required by placing an asterisk (*) next to the field to be filled in the form.

Collection of Browsing Data Browsing Data includes:

The identifier and content of a cookie stored by us on your device;

The IP (Internet Protocol) address of the device connected to the Internet;

The date and time a device connected to an electronic communication service;

The type of operating system used by the device (Windows, MacOS, etc.);

The type and version of the web browser used by the device;

The language used by the web browser.

Browsing Data is collected by installing cookies on your device (computer, tablet, smartphone, etc.).

A cookie is a small file downloaded to your device when you browse a website that enables certain functionalities of the LIVEE websites and services. Cookies may be installed by LIVEE or third parties to achieve the purposes stated in Article 5 herein (such as identifying your computer, generally securing your access to LIVEE websites and/or services, etc.).

Use of Your Personal Information by LIVEE

The Personal Information that LIVEE collects directly from you, particularly when creating a user account or using our websites and/or services, may be processed for the following purposes:

For “customer management” operations concerning:

Your requests (information requests, quotes, orders);

Provision of LIVEE services;

Customer relationship management (such as satisfaction surveys, complaint handling, etc.).

Recipients of Your Personal Data The following may access your Personal Information:

LIVEE personnel in charge of marketing, sales, customer relations and prospecting, administrative services, project management services, internal control procedures, logistics and IT services as well as their supervisors;

Control services (internal LIVEE service but also the statutory auditor, etc.);

Subcontractors under signed contracts;

LIVEE’s current and future subsidiaries;

Any company in the context of a change of control of our company (majority stake, partial transfer of assets, sale of business assets, merger acquisition, without this list being exhaustive);

Court officials and legal assistants, if applicable, in the context of any public procedure and/or order;

The French Data Protection Authority (CNIL) and/or any other competent supervisory authority;

LIVEE’s business partners.

Commercial Prospection

When creating your user account and/or registering for or using certain LIVEE services on the websites and/or apps, you may have the option to:

Receive information on current or future LIVEE products and/or services;

Receive information on products and/or services from LIVEE partners;

Receive dedicated newsletters on certain topics (training, collaboration methods, new workspaces, etc.) created by LIVEE or its partners.

If you choose to subscribe to a newsletter or accept to receive direct prospecting emails from LIVEE (or its partners), you have the right to object to receiving any further newsletters or direct prospecting emails from LIVEE (or its partners):

For newsletters:

By clicking the hyperlink in each newsletter received.

For direct prospecting emails:

By clicking the hyperlink provided for this purpose in each solicitation email sent.

For LIVEE products or services:

You may receive direct prospecting emails from LIVEE teams regarding products we have provided to you via the LIVEE websites or services. In this case, you can always object, free of charge, to any further solicitation via the hyperlink provided for this purpose.

Data Retention Period

We retain your Personal Information for as long as your user account exists or as long as necessary to provide services related to our services.

Personal Information used for sending commercial information or prospecting is kept in accordance with the French Data Protection Authority’s recommendations in its Deliberation No. 2016-264 of July 21, 2016, i.e. three (3) years from its collection or your last contact.

You can of course delete your user account, object to commercial prospecting or unsubscribe from these mailing lists by exercising your rights as listed below.

Maintaining your Personal Data in our information system has a legitimate administrative, legal and security interest. This retention beyond the purposes stated in Article 5 “Use of Your Data” is necessary to process your requests for objection, limitation of processing operations and deletion of your Personal Information and to satisfy any legal, accounting or tax obligation to retain personal data (particularly for evidentiary purposes) or to communicate to authorized authorities (administration, police services, etc.). We undertake to maintain a high level of security and confidentiality of your data, to restrict access to only authorized persons and not to process it for purposes to which you have not consented.

Information and Exercise of Your Rights

In accordance with the Applicable Regulations and in particular Articles 15 to 22 of the GDPR, you can:

Send us any request for information relating to the LIVEE Privacy Policy and the processing of your personal data;

Access information concerning the processing of your personal data (category of data, purposes, etc.);

Delete your user account by contacting us by email;

Correct or update personal data that is inaccurate, by logging into your user account and modifying the settings (when this option is available) or by contacting us by email;

Limit the processing operations of your personal data that we carry out, when you dispute the accuracy of the personal data (limitation for a period allowing us to verify the accuracy of your personal data), or the lawfulness of the processing (but you authorize us to continue), by contacting us by email;

Receive a copy of your personal data, in a structured, commonly used and machine-readable format by contacting us by email; it being specified that any request for a copy beyond the first one may generate administrative processing costs that will be invoiced to you. You are informed that Personal Data derived, calculated or inferred by us from the data you provide us is excluded from the right to data portability, insofar as it is not provided by you, but created by us;

Object at any time to the processing of personal data for direct marketing purposes by unsubscribing from the mailing list by clicking the dedicated hyperlink in the direct marketing email;

Decide not to be subject to automated decision-making: the right not to be subject to a decision based solely on automated decision-making, including profiling, where the decision would have a legal effect on you or produce a similar significant effect;

In the event of excessive requests from you, particularly due to their repetitive nature, we reserve the right not to respond to any subsequent request for access to your personal data after a request for access to your personal data has been duly satisfied by us.

Your requests must be sent in writing to the contact details indicated below, or by email to rgpd@livee.com, be signed and accompanied by a photocopy of an identity document bearing the holder’s signature. The request must specify the address to which the response should be sent. We will have one (1) month to respond upon receipt of the request. If necessary, this period may be extended by two (2) months, taking into account the complexity and number of requests.

Security and Confidentiality

LIVEE implements organizational and technical security measures designed to guarantee the confidentiality and integrity of your personal data. All our data stored on our servers is protected by a secure portal under the HTTPS protocol, data encryption in transit under the SSL protocol, firewalls, use of antivirus software, access management, and intrusion detection.

However, given the very nature of the public network that is the Internet, you accept that the security of transmissions via the Internet and the integrity of Personal Data cannot be guaranteed.

In the event of a security breach resulting in a violation of personal data, we undertake to implement corrective measures as soon as possible and to report this violation to the CNIL, unless the violation in question is not likely to pose a risk to the rights and freedoms of individuals, in accordance with the provisions of the Applicable Regulations.

Transfer of Personal Information Abroad

As part of the purposes listed in Article 5, all or part of the Personal Information may be transferred to recipients located in countries other than France.

LIVEE ensures that your personal data is effectively protected. Thus, all transfers are made to recipients located:

In countries that, according to the criteria established by the European Commission, have an adequate level of personal data protection;

In countries that do not offer adequate protection but to which the transfer is governed by the standard contractual clauses issued by the European Commission or by the adoption of binding corporate rules;

In the United States, provided that these recipients meet the conditions set by the “Privacy Shield” established by the U.S. Department of Commerce.

Changes to the Privacy Policy

We may modify the Privacy Policy at any time and, if we make significant changes, we will inform you by email to the address provided when creating your User Account, to give you the opportunity to review the changes before they take effect.

If you object to any of the modifications, you can delete your user account. If you continue to browse our website and/or use our services after the publication or sending of a notice concerning the changes made to this Privacy Policy, this means that you accept the updated Privacy Policy without reservation.
